..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st respondent to permit the petitioner to participate in the tender to be held on 24.03.2017 as per his notification in Tender notice invites the item rate bids, in electronic tendering system, for construction of roads under THAI II 2016-17 without insisting the availability of tools, plants and its working condition certificate.

O R D E R

The Petitioner has approached this Court seeking a direction to the 1st respondent to permit the petitioner to participate in the tender to be held on 24.03.2017 as per his notification in Tender notice, inviting the item rate bids in electronic tendering system for construction of roads under THAI II 2016-17 without insisting the availability of tools, plants and its working condition certificate.

2.According to the petitioner, the working condition certificate was not issued to the petitioner to enable him to participate in the subject tender.

3.When the matter was taken up for hearing, it was represented by the learned Additional Government Pleader appearing for the respondents that the officials will visit the premises and on https://hcservices.ecourts.gov.in/hcservices/

inspection the issuance of necessary certificate would be finalized and in this case on 23.03.2017, the officials have visited the premises of the petitioner and issued the certificate to him. Therefore, the learned Additional Government Pleader appearing for the respondents would submit that with the issuance of the present certificate, it is open to the petitioner to participate in the tender, which is likely to be opened by 3.00 p.m. today (24.03.2017).

4.Therefore, the petitioner is directed to go and appear before the competent authority and submit the certificate and on production of such certificate, the tendering authority shall accept the certificate and consider the claim of the petitioner along with others.

5. With the above direction, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous petitions are closed.
