PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondents 1 and 2 to remove the name of the petitioner from the History Sheet in H.S.No.625 of 2008 maintaining by the respondent No.3 against the petitioner by considering the petitioner's representation dated 26.08.2021 within the time stipulated by this Court.

ORDER

This petition is filed seeking direction to the 1st respondent herein to consider the representation dated 26.08.2021 for removing the name of the petitioner from the History Sheet in H.S.No.625 of 2008.

2.The case of the petitioner is that he is a Social Activist engaged in Thaineri Trust and other Organizations. The cases have been registered against this petitioner during the years 2003, 2005 and 2008 and in all the cases, the petitioner is appearing before the concerned Court. Except the aforesaid cases, no other criminal case has been registered against this petitioner. On the basis of the previous complaints, History Sheet has been opened in H.S.No.625 of 2008. Since after 2008, no criminal case is pending against this petitioner, he made a representation to the respondents to remove his name from the History Sheet on 26.08.2021. Since there is no action, this petition has been filed.

Crl.O.P.(MD)No.13054 of 2021 3.The learned Additional Public Prosecutor (Crl.side) appearing for the respondents would submit that the petitioner is involved in very number of criminal cases, based upon which, only History Sheet has been opened against him. However, he would submit that the 1st respondent is ready to consider the representation made by the petitioner and pass orders on merits, if so directed by this Court. 4.Considering the limited request that has been made by this petitioner, there shall be a direction to the 1st respondent to consider the representation dated 26.08.2021 within a period of 4 weeks from the date of receipt of a copy of this order and dispose of the same on merits.

5.With the aforesaid direction, this petition is disposed of.
