The Petitioner herein seeks a direction to the respondents to survey the properties in S.No.1149/2A, Patta No.8729 and S.No.1127, Patta No.9776 situated at Devadanapatti Village, Periyakulam Taluk, Theni District on the basis of the Petitioner's application, dated 13.5.2025 as well as to direct the third respondent to give adequate police protection during survey conducted by the second respondent.
2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.Side) takes notice for the third respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 2/6
3.The Petitioner claims right over the subject property under two sale deeds, dated2.9.2013 and 8.9.2021.He submitted an application before the first respondent seeking survey of the above mentioned lands on 13.5.2025. The same has not been considered till date. Hence the Petitioner has come before this Court, for the relief stated supra.
4.Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondent 1 and 2 would submit that the Petitioner has not produced the acknowledgment for submitting the online application and if such acknowledgment for submitting online application is produced, it will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the case, the Petitioner is directed to submit the acknowledgment for submitting online application to the first respondent within a period of two weeks from the date of receipt of a copy of this order. On such production of the acknowledgment, the first respondent is directed to consider the online application of the Petitioner and pass orders on its own merits after issuing notice to the Petitioner fourth respondent and other interested parties, if any, within a period of 12 weeks 3/6
thereafter. .
6.With the above directions, the Writ Petition stands disposed of. No costs.
