ORDER

The petitioner seeks a direction to the respondents 1 and 2 to survey the land in Survey No.72/7 with an extent of 0.20.5 Ares, Pallavarayenenthal Village, Vallam Group, Manjur, Paramakudi Taluk, Ramanathapuram District.

2.Heard the arguments of Mr.K.Yasar Arafath, learned counsel appearing for the petitioner and Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents 1 and 2. Since no adverse order is passed against the third respondent, notice to the third respondent is dispensed with.

3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.According to the petitioner, the above mentioned land was

assigned in favour of the petitioner by an order dated 23.03.2012. After assignment, mutation had taken place and patta was also issued in the name of the petitioner in Patta No.1554. Subsequently, the third respondent filed an application before the Revenue Divisional Officer, Paramakudi, seeking issuance of patta in his name. The same was rejected on the ground that patta already stands in the name of the petitioner. Now, the petitioner submitted an online application on 01.07.2025 seeking survey of the property in Application No. 2024/0123/27/001637. The same has not been considered till date. Therefore, the petitioner has come before this Court. 5.

The learned Government Advocate appearing for the respondents 1 and 2 would submit that the online application of the petitioner will be considered on its own merits within the time stipulated by this Court. 6.It is seen from the averments found in the affidavit filed in support of the writ petition that the third respondent has objected to the survey of the property. Therefore, the survey of the property could not be carried out.

merits of the matter, the respondents 1 and 2 are directed to consider the online application of the petitioner dated 01.07.2025 and pass final orders on its own merits, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the third respondent. Accordingly, this Writ Petition is disposed of. No costs.
