Contemnors/Appellants PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents herein for their willful, deliberate and disobedience of the order passed by this Court in W.A(MD)No.1386 of 2015, dated 21.03.2018 under the Contempt of Courts Act.
For petitioner : Mr.M.Sakthikumar For Respondents : Ms.J.Maria Roselin COMMON ORDER ****************** (Order of the Court was made by M.S.RAMESH, J.) In the judgment, dated 21.03.2018 made in W.A(MD)Nos.1378 to 1386 of 2015, the direction to the respondents therein, was to provide regular time scale of pay in the Post of the Security Guard or any other equivalent post and permit the petitioners to continue in service. There was no specific directions for regularization of the petitioners' service.
2. In this background, these contempt petitions have been filed alleging that the petitioners' services had not been regularized and therefore, the respondents committed disobedience of the order of the coordinate Bench.
3. Today, when the matter was called, the learned counsel for the respondents submitted that insofar the directions of the coordinate Bench for providing regular time scale of pay in the post of Security Guard, is concerned, the same has been complied with. It is also her submission that since the petitioners alleged that they are entitled for regularization, they have challenged the order passed in the writ appeals before the Honourable Supreme Court and the same is pending.
4. We are of the view that since there was no specific direction for regularization of the petitioners' services and also taking note of the fact that the petitioners have challenged the order passed in the writ appeals denying regularization, the present contempt petitions cannot be maintained. Accordingly, these Contempt Petitions stand closed. [M.S.R.,J.] & [R.T.,J.] 23.11.2022 Internet : Yes/No pm
