Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to remove the encroachment made by the 5th and 6th respondents in S.No.3, North side of Maranthai Checkdam, Vellakkal Village, Veerakeralampudur Taluk, Tenkasi District, based on the petitioner's representation dated 17.03.2025. ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4. Considering the nature of relief to be granted, issuance of notice to the respondents 5 and 6 is dispensed with.

2.The petitioner is a permanent resident of Thuvarankadu Village. He alleges that in Survey No.3 which has been classified as "channel", encroachments are coming up. The character of Survey No.3 as a channel is accepted by the Government side.

3.We direct the respondents 3 and 4 to issue notices to the encroachers and give them due opportunity and conduct enquiry. If the results of the enquiry confirmed that there are encroachments, they shall be removed. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

4.This Writ Petition is allowed accordingly. There shall be no order as to costs.
