No. 810 of 2018 on the file of the Motor Accident Claims Tribunal/Special Sub Court, Tirunelveli. Prayer in CMA(MD). 1086/ 2022 :

Civil Miscellaneous Appeal filed under section 173 of Motor Vehicles Act to call for the records relating to the order and decreetal order dated 28.03.2022 passed in MCOP. No. 810 of 2018 by the Motor Accident Claims Tribunal/Special Sub Court, Tirunelveli and to set aside the same.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.RAJAMOHAN, Advocate for the petitioner,while admitting the CMA., the court made the following order:- On the side of the appellant it is stated that 50% contributory liability was fixed on the Corporation. Reasons stated in this petition are satisfactory.

2.There shall be an order of Interim Stay, till the disposal of the appeal on condition that the petitioner/appellant appellant deposits 25% of the award amount with proportionate interests and https://www.mhc.tn.gov.in/judis 1/2

C.M.P(MD)No.11050 of 2022 costs, awarded in M.C.O.P.No.810 of 2018 on the file of the Motor Accidents Claims Tribunal (Special Sub Court), Tirunelveli, within a period of four weeks from the date of receipt of a copy of this order, with proportionate accrued interest, to the credit of M.C.O.P.No.810 of 2018 on the file of the Motor Accidents Claims Tribunal (Special Sub Court), Tirunelveli, less any amount already deposited, failing which, interim stay granted shall stand automatically vacated.

3.Hence, this petition is disposed of.
