ORDER

This writ petition has been filed for a Mandamus, directing the first respondent to issue passport to the petitioner by considering his application dated 15.04.2025.

2. The learned Government Advocate for the second respondent submits that the petitioner is arrayed as Accused No.2 in Crime No.296 of 2024, dated 30.12.2024, registered under Section 296(b), 118 (1), 109, 351

(3) of BNS Act, 2023. The learned Government Advocate for the second respondent submits that a charge sheet has been prepared and is ready to be filed, and will be filed in due course.

3. Since the charge sheet has been prepared and is yet to be filed, there shall be a direction to the second respondent to file the charge sheet as expeditiously as possible, preferably within a period of two weeks from the date of receipt of a copy of this order. Thereafter, it is open to the petitioner to approach the concerned Magistrate Court for appropriate relief to facilitate the first respondent to issue the passport. In case, the charge sheet is not filed 2/4

before the concerned court within the stipulated time, the first respondent shall issue the passport to the petitioner.

4. The writ petition stands disposed of. There shall be no order as to costs.
