Respondents Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondent No.4 to lay the road under Urban Road Infrastructure Programme in B.T.Roads and Paver Block Roads in Ward Nos.1 to 21 at Keelakarai Municipality, Ramanathapuram District only after completion of ongoing drinking water pipeline project within the time stipulated by this Court.

ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner has come up with this public interest litigation seeking a direction to the respondents to lay road under the Urban Road Infrastructure Programme in B.T.Roads and Paver Block Roads in Ward Nos.1 to 21 at Keelakarai Municipality, Ramanathapuram District only after completion of ongoing drinking water pipeline project.

2. We have heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents and we have also perused the records.

3. Today, when the matter was taken up, the learned Additional Government Pleader produced a letter of the Commissioner, Keelakarai Municipality, Ramanathapuram District, under letter in Na.Ka.No.109/2016/,1 dated 16.09.2016, wherein, she has informed the learned Additional Government Pleader that pipelines have already been laid and only after the same, the road project is to be taken for execution. The same is recorded.

4. In view of the same, nothing survives for adjudication in the writ petition. Accordingly, the writ petition is dismissed as infructuous. No costs. Consequently connected Miscellaneous Petition is also dismissed.
