For Respondent : Mr.KR.Bharathi Kannan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 391 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners/A1 and A5 who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 188, 269, 270,506(ii) of IPC and Section 67 of I.T Act r/w.Section 3 of Epidemic Diseases Act 1897 and Section 51 of Disaster Management Act seeks anticipatory bail. 2.The case of the prosecution is that inorder to threaten the rival group the petitioner along with other accused persons celebrated the birthday of A1 by cutting cake in a open place using sickle and shared the celebration through whatsapp.
The motive behind the occurrence was that the rival group should be threatened. 3.A recent trend has been developed across the State of Tamil Nadu to celebrate the birthday by using sword and other arms inorder to threaten other groups and such celebrations are openly https://hcservices.ecourts.gov.
CRL OP(MD). No.13113 of 2020 shared through whatsapp, twitter and other electronic modes. Such antisocial activities ought to be curved without showing any leniency. Maintaining orderliness must be properly taught to such persons and in the event of such persons who continue such activities it will get fear in the mind of people who are witnessing the incidents through electronic modes.
4. In the present case the petitioner is absconding accused and the accused 2,3 and 4 were remanded . Under such circumstances the petitioners cannot be released on anticipatory bail and in the event of releasing the petitioner it will certainly hamper further investigation.
