JUDGMENT

(Judgment of the Court was delivered by D.Bharatha Chakravarthy, J.) The issue of maintainability is held in favour of the appellant since the issue relates to fencing the petitioner's land. As such, the writ appeal is held to be maintainable.

2. As far as the merit is concerned, the case of the petitioner is that the petitioner is the owner of the property. Unnecessarily without any right, title or interest, third parties and anti social elements with the help of advocates are trying to interfere with the petitioner's act of fencing the property.

3. It can be seen that before the learned Judge, no such private person was impleaded. The learned Judge, after considering the dispute with reference to the title, has relegated the petitioner to work out the remedy before the appropriate forum and we are in agreement with the same.

4. If any person is interfering with the possession and enjoyment of the petitioner, it is for the petitioner to move the Civil Court as and when any decree or any interim order is passed, the respondent police will give protection for the petitioner to erect the fencing. Keeping such liberty open to the petitioner, the writ appeal stands disposed of. No costs. (D.B.C., J.)
