ORDER

Heard the learned counsel on either side.

2. The petitioner alleges that the fifth respondent is likely to destroy water channels in the process of installing the windmill in the petition mentioned survey numbers.

When the matter was taken up for hearing, the learned Senior Counsel appearing for the fifth respondent undertook before this Court that they may at best seek temporary permission for taking their equipments for installing the windmill in Survey Nos. 624/1A, 624/2A in Ottapidaram Village. It is not in dispute that these survey numbers are patta lands. The grievance of the petitioner is that the petitioner should not damage any water channel in the process of erection of the windmill. We make it clear that even if temporary permission is granted, the authorities will ensure that the fifth respondent will restore the original position of the water bodies after installation of the windmill. With this direction, this writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
