O R D E R

This Criminal Original Petition has been filed to direct the third and fourth respondents not to harass the petitioner.

2. The grievance of the petitioner is that based on the complaint given by the fifth respondent alleging that the petitioner has received money on promise that he would arrange for employment in abroad and cheated him, the respondent police is

harassing the petitioner. Hence, the petitioner has filed the present petition.

3. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side), on instructions, would submit that based on the complaint given by the fifth respondent stating that the petitioner has received a sum of Rs.2,93,000/- for petitioner's employment at Viettnam and the petitioner failed to do so, now an enquiry has been conducted and the petitioner was directed to appear before the respondent police for enquiry. But the petitioner without appearing for enquiry has filed the present petition. He would further submit that enquiry on the said complaint is now pending.

4. Considering the fact that the enquiry on the complaint lodged against the petitioner is pending, the petitioner is directed to appear before the respondent police and cooperate with the enquiry. However, the respondent police is directed not to harass the petitioner under the guise of enquiry.

5. With the above direction, this Criminal Original Petition is disposed of.
