Prayer for Crl.M.P(MD)No.9924/2026:
To pass an order to exempt the petitioner from being surrender for undergoing judicial custody in connection with the conviction and sentence imposed on him by means of a judgment passed by the Hon'ble Principal Sessions Court, Sivagangai District vide Crl.A.No.80 of 2025 dated 10.04.2026 in connection with the judgement dated 07.11.2025 passed by the learned Principal District Munsif cum Judicial Magistrate, Thiruppathur, Sivagangai District vide C.C.No.102 of 2015, pending disposal of the above Criminal Revision Case. COMMON ORDER Heard Mr.A.Anbalakan, learned Counsel for the petitioner and Mr.Abul Kalam Azad, learned Government Advocate (crl.side) and perused the materials available on record.

Criminal Miscellaneous Petitions have been filed praying to suspend the sentence imposed upon petitioner by Principal District Munsif cum Judicial Magistrate, Thirupatthur in C.C.No.102 of 2015 dated 07.11.2025, which was modified by Principal Sessions Court, Sivagangai District in Crl.A.No.80 of 2025, dated 10.04.2026 and to exempt the petitioner from surrendering before the Court below. 2/7

The learned Counsel appearing for the petitioner would submit that the petitioner was convicted by the Principal District Munsif cum Judicial Magistrate, Thirupatthur, Sivagangai District for the offences punishable under Sections 279, 304A of IPC in C.C.No.102 of 2015 dated 07.11.2025 and sentenced as follows:- (I) For the offence under Section 279 of IPC, to undergo one month Rigorous Imprisonment and to pay fine of Rs.1,000/- in defult, to undergo 2 weeks default sentence.
(ii) For the offence under section 304A of IPC, to undergo one year Rigorous Imprisonment and to pay a fine of Rs.5,000/- in default, to undergo three months default sentence.

Aggrieved, the petitioner herein filed Criminal Appeal No.80 of 2025, before the learned Principal Sessions Judge, Sivagangai District, the lower Appellate Court vide order dated 10.04.2026, dismissed the appeal and modified the judgment passed by the Trial Court. The sentence passed by the learned Principal Sessions Judge, Sivagangai District vide order 10.04.2026 are as follows: (I) For the offences under section 304A of IPC, to undergo six month Rigorous imprisonment and to pay fine of Rs.5,000/- in default, to undergo three months default sentence.

(ii) For the offence under Section 279 of IPC, to undergo one month Rigorous Imprisonment and to pay fine of Rs.1,000/- in defult, to undergo 2 weeks default sentence.
5. Challenging the above conviction and sentence, petitioner has filed Criminal Revision case in Crl.RC(MD)No.852 of 2026 before this Court along with the instant miscellaneous petitions seeking suspension of sentence, bail and exemption from surrender.
6. The learned Counsel appearing for the petitioner would further submit that petitioner has raised substantial grounds in the above revision, which requires consideration. Hence, he prayed for granting suspension of sentence and bail to petitioner.

Learned Government Advocate appearing for the respondent has opposed the submissions made by the learned Counsel for the petitioner and submits that the judgments passed by both the Courts are as per law after considering the entire evidence, thus the relief sought by the petitioner at this stage be refused by this Court. 4/7

Considering the fact that there are arguable points raised in revision and taking into consideration of the facts and circumstances of the case, this Court is inclined to grant suspension of sentence, bail and exempt the petitioner from surrendering before the trial court, on the following conditions, till the disposal of the above Criminal Revision:
i) Petitioner is directed to be enlarged on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Principal District Munsif cum Judicial Magistrate, Thiruppathur, Sivagangai District;
ii) Petitioner and sureties shall affix their photographs and Left Thumb Impression in the bond and the above said Court may obtain a copy of their Aadhaar card or Bank pass Book to ensure their identity; iii) Petitioner shall appear and sign before the learned Principal District Munsif cum Judicial Magistrate, Thiruppathur, Sivagangai District, on the first working day of every English calendar month at 10.30 a.m., until further orders; iv) In case, petitioner is not able to appear before the said Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. (corresponding to 355 B.N.S.S) and shall appear before the said Court on any other day in lieu of the date of his absence, as directed by the said Court. 5/7
