For Respondent : Mr.B.THANGA ARAVINDH, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 1854 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police, for the offence punishable under sections 380, 457 of IPC, in Crime No.1854 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons have broke open the house of the defacto complainant and stolen the valuable gold and silver ornaments and cash. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and a false case has been foisted against this petitioner.

4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the specific allegation against the petitioner is that he was standing in front of the house of the defacto complainant and watching the movements of general public. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.13375 of 2022 He further submitted that there are five previous cases pending against him. Out of five cases, three are pending; (i) in Crime No.1145 of 2021 for the offence under Section 46 of TNCP Act, on the file of the Anna Nagar Police Station, (ii)in Crime No.589 of 2008 for the offences Under Sections 147, 294(b), 341 of IPC and 3(1) of TNPPDL Act on the file of the Manamadurai Police Station and (iii)in Crime No.502 of 2008 for the offences under Sections 147, 148 of IPC and Section 3(1) of TNPPDL Act on the file of the Thiruppuvanam Police Station.

5.Considering the seriousness and gravity of the offence alleged as against the petitioner and also the fact that four previous cases are pending against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this Criminal Original Petition stands dismissed.
