PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 324 and 506(ii) of I.P.C and Section 3 of Tamil Nadu Public Property (Prevention of Damages and Loss) Act, 1992 in Crime No.160 of 2018, seeks anticipatory bail.

2.The case of the prosecution is that the accused persons and the defacto complainant are neighbours and there was a land dispute between them. Due to the above motive, on 24.06.2018, the accused persons entered into the defacto complainant shop. They attacked the defacto complainant with deadly weapon and used filthy languages. Further, the accused persons caused damages to his car and shop, worth about 1.5 lakhs. Hence, the complaint. 3.Heard the learned counsel appearing for the petitioner. 4.The learned Additional Public Prosecutor for the respondent police submitted that the injured has been discharged from the hospital.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released https://hcservices.ecourts.gov.in/hcservices/

on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Paramakudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., for a period of two weeks. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
