O R D E R
(Order of the Court was made by G.R.SWAMINATHAN, J.) This writ petition has been filed for forbearing the private respondents from quarrying rough stone and gravel in Aladipatti Tank situated in S.No.77 at Aladipatti Village, Arupukottai Taluk, 2.The ground on which such an order of restraint is sought is that quarrying would violate the Rules set out in Rule 36(1) of Tamil Nadu Minor and Mineral Concession Rules, 1959. 3.When the case was taken up for hearing, it was pointed out by Mr.Veerakathiravan, learned Senior Counsel appearing for the 13th respondent that the prohibition of quarrying within 500 meters from the water body would apply only in the case of sand quarrying and not in the case of rough stone and gravel. Therefore, invocation of the said Rule in the present case was wholly misplaced. 4.
We went through the said provision and we find that the said contention of the learned Senior Counsel for the private respondent is well founded. The third respondent has also filed a report stating that there is no violation of the statutory provisions in the present case. It is averred that quarrying permits were granted by the District Administration after following the legal procedure and after leaving 50 metres safety distance from Aladipatti Tank situated in S.F.No.77 of Aladipatti Village and 300 meter from the habitation.
the water body is not applicable in this case, we find no reason to grant the relief sought for in this writ petition. 5.This writ petition stands dismissed.
No costs.
