Respondents Prayer : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent No.1 to depute a competent special officer to remove the encroachments made by the private individuals on a Pond in front of SivanTemple and 14 irrigation channels and on both the side of road from police quarters to Salaigiramam Panchayat office and also within the bus stand in Salaigiramam Village, Ilayangudi Taluk, Sivagangai District, in accordance with law within the time stipulated by this Court.

ORDER

(Order of the Court was made by M.SATHYANARAYANAN,J) After some arguments, the learned Counsel appearing for the petitioner seeks permission of this Court to withdraw this Writ Petition, with liberty to submit a fresh representation, for removal of encroachment in Survey Nos.371, 372/5, 378, 379, 380/3A, 380/3B, 380/4A, 383/2, 384/2, 388/2, 389 and 390/2 of Salaigiramam Village, Ilayangudi Taluk, Sivagangai District with supporting materials and also made an endorsement to that effect.

2. In the light of the endorsement made, this Writ Petition is dismissed as withdrawn and liberty sought for by the petitioner is granted and in the light of the same, he is at liberty to submit a fresh representation with supporting documents as to the removal of the alleged encroachment from the above cited lands, to the respondents 1 to 3. No costs.
