Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance a Writ of Certiorarified Mandamus to call for the records of the second respondent herein by his proceedings dated 15.07.2016 in CBSE/RO(M)/ CORRN/REJN/EN/8933/2015 by rejecting my request to correct and change the spelling mistake of my name in my daughters grade sheet cum certificate of performance issued by the 1st respondent school certificate as illegal and quash the same and direct the respondents 1 and 2 herein to correct the spelling mistake in the 10th standard certificate issued by the 1st respondent.

ORDER

This writ petition has been filed seeking to quash the impugned proceedings of the second respondent dated 15.07.2016 in CBSE/RO(M)/CORRN/REJN/EN/8933/2015 and consequently direct the respondents 1 and 2 to correct the spelling mistake in the X standard certificate issued by the first respondent. https://hcservices.ecourts.gov.in/hcservices/

2.The learned counsel appearing for the petitioner would submit that in the Transfer Certificate and Mark Sheet of her daughter V.Janani, his name is mentioned as K.Veerabadran instead of K.Veerabudiran. Hence, in order to get his name corrected in the Transfer Certificate and Mark Sheet, the petitioner has sent several representations to the respondents. But, the third respondent has rejected the claim of the petitioner by passing the impugned order dated 15.07.2016. Aggrieved by the same, the petitioner is before this Court, by filing the present writ petition. 3.

Considering the limited scope of the relief sought in the writ petition, this Court, directs the respondents 1 and 2 to consider the claim of the petitioner to correct his name in the Transfer Certificate, upon production of her daughter's birth certificate and any other relevant document showing the correct spelling of the petitioner's name issued by the competent authority and on such production, if it is found fit, the respondents 1 and 2 shall issue a fresh Transfer Certificate, after mentioning the correct name of the petitioner, within a period of four weeks from the date of receipt of a copy of this order. It is always open to the petitioner to approach the competent authority, in respect of correction of his name in the mark statements. 5.With the above direction, the writ petition is disposed of. No Costs.
