For Respondent : Mr.T.Senthil Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No. 161 of 2021 on the file of the respondent police ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offence punishable under Sections 6(4) of TNSC RDCS Order 1982 r/w 7(1) (a) (ii) of EC Act, 1995, in the Crime No.161 of 2021, Seek anticipatory bail.

2.The case of the prosecution is that while the respondent police was on patrol duty on 11.08.2021 at 8.00 a.m., near TVS Nagar 3rd Main Road in Palayamkottai, on a secret information, they searched the thatched shed of one Muthumalaiammal and found that 130 bags of ration rice are stocked in the shed. Each bag contains 40 kg which totally comes to 5,200 kgs.

this Court had granted interim bail to the petitioners for a period of two weeks with a direction to the petitioners to appear before the respondent police daily for enquiry and also directed the respondent police to file a report before this Court. 4.As per the directions of this Court, the respondent police filed a detailed report before this Court, wherein it is stated that the petitioners have not given any details with regard as to where they collected the PDS Rice and also stated that the petitioners did not appear before the respondent police for enquiry.

5. Considering the conduct and the attitude of the petitioners and also the quantity of PDS rice, this Court is not inclined to grant anticipatory bail to the petitioners.
