Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the second respondent in his proceedings Nil dated 21.03.2017 and quash the same as illegal and consequently directing the respondents to grant permission for conducting Adal Padal Kalai Nigalchi dated 30.03.2017 at Sri Arulmigu Muthalamman Temple, Koduvilarpatti Village, Theni District.

[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the proceedings dated 21.03.2017 passed by the second respondent and quash the same, by way of issuing a Writ of Certiorarified Mandamus.

2.Mr.K.Guru, learned Additional Government Pleader, has taken notice for the respondents.

mentioned in the petition, a representation has been given, but the second respondent has rejected the same by way of assigning a flimsy reason on the ground of law and order problem. Under the said circumstances, the proceedings of the second respondent is liable to be quashed.

4.It is seen from the impugned proceedings that the second respondent has rejected the representation alleged to have been given by the petitioner on the ground of law and order problem. Under the said circumstances, this Court is inclined to pass the following order.

5.In fine, this Writ Petition is allowed in part without costs and the impugned proceedings, dated 21.03.2017 passed by the second respondent is quashed. However, the second respondent is directed to look into the representation alleged to have been given by the petitioner and pass orders on merits if permission is granted and if any untoward incident is happened, the petitioner is solely liable for all inconvenience and damages.
