ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 341, 342, 447, 294(b), 506(ii) I.P.C, in Crime No.242 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the lorry which belongs to the defacto complainant's company was intercepted by the petitioner on 07.07.2022 and taken away the key of the lorry. By using another key, the vehicle was taken by the defacto complainant. Therefore, on 08.07.2022 at about 08.30AM, the petitioner trespassed into the defacto complainant's company and abused them in filthy language and threatened with dire consequences. Hence, the complaint.
3. The learned counsel for the petitioner submitted that on the next day the key was handed over to the defacto complainant's company.
4.Today, the respondent Police appeared before this Court and stated that it is the usual practice of the petitioner to make such trouble for extorting money from public and there is no information with regard to key handed over to the Company. https://www.mhc.tn.gov.in/judis 1/2

5. Though the petitioner is not having any bad antecedents, considering the conduct of the petitioner and nature of offence, this Court is inclined to grant anticipatory bail to the petitioner, only the basis of stringent conditions.
6. Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate No.V, Tirunelveli on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall file an undertaking affidavit before the trial Court that he will not indulge in similar kind of activities in future. The respondent Police keep an eye on the petitioner's conduct. If any violation and any untoward is noticed, the anticipatory bail granted to the petitioner in this case, will automatically stands cancelled, without further reference to this Court. Further, the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
