Criminal Original Petition filed under section 482 of Criminal Procedure Code, praying to direct the District and Sessions Judge (PCR Court) Sivagangai, to consider and pass orders on bail application to be filed by the petitioner in connection with Cr.No.453 of 2020 pending on the file of the Manamadurai Police Station on the same day.

ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon perusal of the earlier order of this Court and upon hearing the arguments of Thiru.S. Pandiyaraj, Advocate for the Petitioner and of Thiru. V. Neelakandan, Government Advocate for the 1st and 2nd respondent, this Court made the following order: This criminal miscellaneous petition has been filed to extend the time for surrender before the learned District and Sessions Judge (PCR Court) Sivagangai in Crl.O.P(MD).No.5724 of 2020, order dated 05.06.2020.

2.The learned counsel for the petitioners would submit that due to the lockdown owing to Covid-19 pandemic, the petitioners could not able to surrender before the Special Court in time. Hence, they filed a petition in Crl.M.P(MD).No.5023 of 2020 to extend the time to surrender before the concerned Court and on 09.10.2020, this Court granted two weeks time to surrender. The learned counsel further submitted that the order copy was made ready on 16.10.2020. The petitioners have to surrender on or before 30.10.2020. But, the petitioners 3, 4 and 8 were suffered from fever and due to Dasara holidays, others petitioners also could not able to arrange sureties. Therefore, he seeks further extension of 15 days time to comply with the order of this Court.

3.Considering the facts and circumstances of the case and also considering the submission made by the learned counsel for the petitioners, this petition is ordered and the time for surrendering the petitioners before the concerned Court is extended by 15 days from the date of receipt of a copy of this order.
