Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to forthwith provide the petitioner suitable alternative employment with pay protection, continuity of service and back wages from the date of his disengagement i.e. from 26.02.2025 to till the date on which he is 1/6
provided with alternative light duty as per Section 20(4) of the Rights of the Persons with Disabilities Act, 2016 within a time frame that may be fixed by this Court.

O R D E R
The writ petition has been filed for the issuance of a writ of Mandamus, directing the respondents to provide the petitioner suitable alternative employment with pay protection, continuity of service and back wages from the date of his disengagement i.e. from 26.02.2025 to till the date on which he is provided with alternative light duty as per Section 20(4) of the Rights of the Persons with Disabilities Act, 2016, within a time frame that may be fixed by this Court.
2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner asserts that while he was on duty as a Driver, he became paralyzed and was admitted as an inpatient at KMC 2/6
Hospital, Coimbatore, for ten days from 09.06.2024. Subsequently, he was referred to the Regional Medical Board at Rajiv Gandhi Government General Hospital, Chennai, for a medical examination to assess his fitness to continue working as a Driver. However, the Medical Board certified that the petitioner is unfit to perform the duties of a Driver. The grievance of the petitioner is that, despite the opinion rendered by the Medical Board, the respondents have not provided him with any alternate employment as recommended by the doctors. In this regard, the petitioner submitted a representation on 15.03.2025, requesting that he may be assigned light duty. As no action has been taken on the said representation, the petitioner has now filed the present writ petition.
4. On the other hand, the learned Standing Counsel appearing on behalf of the respondents would fairly submit that the respondents are willing to consider the case of the petitioner.
5. In the light of the above submission, no purpose will be served if the present writ petition is kept pending and therefore, this Court directs the respondents to consider the case of the petitioner based on the report rendered from the Medical Board and pass appropriate 3/6
orders in accordance with law, after giving due opportunity to the petitioner, within a period of two months from the date of receipt of a copy of this order.
6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed. 18.06.2025 Index : Yes / No Internet : Yes / No PKN 4/6
