O R D E R

This criminal original petition has been filed seeking to set aside the order passed by the learned Judicial Magistrate, Mudukulathur in Cr.MP.No.2545 of 2024 in CNR No.TNRM08-002733-24, dated 26.06.2024.

2.The learned Counsel appearing for the petitioner submits that the petitioner is an accused in S.T.C.No.409 of 2017, pending on the file of the learned Judicial Magistrate, Mudhukalathur, for the offence punishable under Sections 139 and 142 Negotiable Instruments Act. The petitioner has filed an application under Section 311 Cr.P.C to reopen the defence side evidence. However, the trial Court has dismissed the application. Therefore, this petition has been filed.

3.After questioning under Section 313 Cr.P.C, the case was posted for defence side evidence on 20.11.2023. The trial Court has provided this opportunity to the petitioner to adduce the defence evidence. Thereafter, the case was posted for arguments on 18.01.2024. The petitioner has also taken 2/4

time during the course of arguments for nearly twelve hearings. Thereafter, she has filed this application to reopen the defence evidence. 4.Since the trial Court has provided sufficient opportunity to the petitioner for adducing defence side evidence and the case was also adjourned for several hearings, this Court is not inclined to entertain this petition.
