Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the rejection order of the second respondent in C.No.57/mike/B2PS/2017 dated 17.03.2017 and quash the same and consequently direct the respondents to grant permission and protection for Adal Padal program sponsored by "Nellai Sachin-Kala Stalin Groups" in connection with "Panguni Pongal Thiruvizha scheduled to be held on 12.04.2017 at 7.00 pm. at Arulmigu Sri Sathavurayan Thirukovil at Balan Nagar, Pommaiyagoundanpatti, Allinagaram Town, Theni Taluk & District by considering the petitioner's representation dated 17.03.2017.

[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the impugned order dated 17.03.2017 passed by the second respondent and quash the same, by way of issuing a Writ of Certiorarified Mandamus.

2.Mr.M.Govindan, learned Special Government Pleader, has taken notice for the respondents.
3.It is seen from the records that the second respondent has partly permitted the petitioner to conduct programme mentioned in the representation, dated 17.03.2017. Under the said circumstances, the present Writ Petition has been filed. 4.The second respondent has rejected the permission of the petitioner for conducting Adal Padal Programme only on the basis of obscene songs will be played. The reason assigned by the second respondent is not proper. Under the said circumstances, this Court is inclined the pass the following order.
5.In fine, this Writ Petition is allowed in part without costs and the impugned order dated 17.03.2017 passed by the second respondent in C.No.57/mike/B2PS/2017 is quashed. The second respondent is directed to look into the representation dated 17.03.2017 afresh and pass suitable orders on merits and if there is any infraction, the second respondent is directed to take appropriate penal action.
