Prayer:This Criminal Original Petition has been filed under Section 482 Cr.P.C. to direct the second respondent police not to harass the petitioner without due procedure of law.

ORDER

This Criminal Original Petition has been filed to direct the second respondent police not to harass the petitioner without due procedure of law.

2.The grievance of the petitioner is that the third respondent is none other than the wife of the petitioner herein. Due to matrimonial dispute, the third respondent/wife lodged a complaint against the petitioner alleging that the petitioner has harassed her. Based on that complaint, the second respondent police is harassing the petitioner under the guise of enquiry. Hence, the present petition has been filed.

3.Mr.K.Suyambulinga Bharathi, learned Government Advocate (Crl.Side) appearing for the respondents 1 & 2, on instructions, would submit that earlier an enquiry has been conducted, in which both parties have appeared, at that time, the petitioner has submitted that he will settle the remaining amount and other things belong to the third respondent on or before 15.09.2019, in turn, the third respondent also agreed to return all the things belong to the petitioner. Recording the above statement, the complaint has been closed.

4.Considering the fact that already a complaint has been closed based on the statements given by the petitioner/husband and the third respondent/wife, no further order is required in this case. However, the second respondent police is directed not to harass the petitioner.

5.With the above observations, this Criminal Original Petition is disposed of.
