Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records in Ka.No.E7/1851/2021 dated 02.05.2022 on the file of the first respondent and quash the same as arbitrary, illegal and contrary to law.

O R D E R

This writ petition has been filed challenging the sanction of loan amount by mortgaging the subject property which is under dispute between the petitioner and the second respondent.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The learned Special Government Pleader appearing for the first respondent, on instruction, would submit that now the entire loan amount has been disbursed in favour of the second respondent. That apart, the petitioner and along with his father already filed a suit in O.S.No.160 of 2022 on the file of the Sub Court, Karur for partition.

4. In view of the above, nothing survives for further adjudication in the writ petition and hence, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
