PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 1st and 3rd respondent to conduct the enquiry to cancel the gift deed document executed by the petitioner to 5th respondent on 08.09.2025 vide Doc.No. 1534/2025 registered in M.Reddiyapatty Sub Registrar Office, Aruppukottai Taluk to be cancelled as per the Welfare and Maintenance of Parents and Senior Citizen Act, 2007 and the same may be handed over to the petitioner by respondents.

O R D E R

Considering the nature of relief that is granted, this writ petition is disposed of at the admission stage without notice to the 5th

respondent. This Court is not expressing any opinion on the merits of the case.

2. It is seen that the petitioner is a senior citizen aged about 75 years, he has made an application under the Welfare and Maintenance of Parents and Senior Citizen Act, 2007 before the 3rd respondent. The 3rd respondent is the competent authority to consider the prayer of the petitioner to cancel the settlement deed dated 08.09.2025 on the ground of nonpayment of maintenance.

3. This writ petition is ordered on the following terms :

1) The petitioner's application dated 09.04.2026 shall be taken up for enquiry by the 3rd respondent, due notice to the 5th respondent and the petitioner shall be issued and after due inquiry, appropriate orders in accordance with law shall be passed. The aforesaid exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

2) It is also be open for the petitioner to plead for any interim order before the 3rd respondent relating to his place of dwelling. The orders with reference to the residence etc., shall be passed as expeditiously as possible. No costs. Consequently, connected miscellaneous petition is closed.
