RESPONDENT/ RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed in Crl.O.P(MD)No.12233/2020 dated 03.11.2020 to execute the bail bond before the Judicial Magistrate, Valliyoor or Tirunelveli Instead of to execute the bail bond before the Judicial Magistrate No.1 Kuzhithurai, Kanyakumari District and thus render justice.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.RAMAKRISHNAN, Advocate for the petitioners and of Mr.K.SUYAMBULINGA BHARATHI, Government Advocate(Crl.Side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition imposed in Crl.O.P.(MD)No.12233 of 2020, dated 03.11.2020.

2.This Court by an order dated 03.11.2020 granted anticipatory bail to the petitioners with a condition to execute a bond for a sum of Rs.10,000/-each with two sureties each for the likesum to the satisfaction of the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District. The learned counsel for the petitioners would submit that the defacto complainant is an advocate, practicing in the local Bar Association and on that reasons, no one appeared as against the petitioners in Kanyakumari District, hence he is unable to execute bail bond before the learned Magistrate. Hence he seeks modification.

CRL MP(MD) No.6056 of 2020 3.Taking into consideration the above facts the condition imposed by this Court directing the petitioners to execute a bond for a sum of Rs.10,000/-each with two sureties each for the likesum to the satisfaction of the learned Judicial Magistrate No.I, Kuzhithurai, Kanyakumari District is modified to the effect that the petitioners shall to execute a bond for a sum of Rs.10,000/-each with two sureties each for the likesum to the satisfaction of the learned Judicial Magistrate No.I, Valliyoor or Tirunelveli.
