Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus Mandamus, directing the respondents 1 to 5 to consider the petitioners' representation dated 27.02.2017 on merits and the fourth respondent may issue Free House site Patta of 3 cents to each petitioner in Survey No.737/1, 2 for an extent of 2 acres situated at Gursadi Methu, Perumpallam, Vilpatti Village, Kodaikanal Taluk in Dindigul District and further forbearing the respondents 2 to 6 from taking any enforcement action against the petitioners' livelihood from the above said place without following the due process of law. O R D E R

*********** [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioners are stated to be in possession of the Poramboke land in Survey No.737/1 & 2, situated at Gursadi Methu, Perumpallam, Vilpatti Village, Kodaikanal Taluk, Dindigul District.

2. It is the case of the petitioners that they have been residing there, after putting thatched huts. The petitioners are stated to be landless poor. The petitioners have come up with a grievance that they would be evicted from the land in question. The petitioners have given a joint representation on 27.02.2017, requesting the fourth respondent to grant them patta.

3. There is no question of issuing patta on the strength of the joint representation. The petitioners must give individual representations so as to enable the Tahsildar to consider each and every matter separately, taking into account the position of the party and as to whether they are already in possession of land.

4. We, therefore, give liberty to the petitioners to submit individual representations to the District Collector, Dindigul. In case such representations are given by the petitioners, the same shall be considered and disposed of by the District Collector, on merits. Such exercise shall be completed within a period of four months from the date of receipt of representations.

5. The Writ Petition is disposed of, with the above direction. No costs. Consequently, connected Miscellaneous Petition is closed.
