PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to take appropriate action and conduct proper enquiry as against the third respondent, in the light of the petitioner's representation/complaint, dated 13.03.2025, in connection with CSR No.81 of 2025, dated 14.03.2025, in accordance with law, as per the 1/5

O R D E R

The petitioner claiming to be a landlord having some issues with his tenant, has approached this Court seeking a direction to the respondent police to take action on his complaint, dated 13.03.2025, as per the direction laid down by the Honourable Supreme Court in Lalita Kumari Vs Government of Uttar Pradesh.

2.The learned counsel for the petitioner submits that there was an amicable settlement between the petitioner and his tenant and on account of that, the house was locked by the petitioner, however the tenant has broke open the lock and entered into the house. 2/5

3.Mr.Antony Sahaya Prabhakar, learned Additional Public Prosecutor, who takes notice for the respondents 1 & 2 submits that the complaint of this petitioner was enquired and it was closed, by advising the parties to approach the competent Court as the dispute is between the land lord and tenant.

4.Recording the aforesaid submissions of the learned Additional Public Prosecutor, this writ petition criminal is closed with a direction to the respondent police to furnish a copy of the closure report to the petitioner enabling him to work out his remedy in the manner known to law. No costs.
