O R D E R
The Petitioner herein seeks a direction to the respondents to 2 and 3 to survey and demarcate the land situated in S.No. 109/1C to an extent of 0.41.50 hectares pertaining to patta No.107 in Karungal Village, Guziliamparai Taluk,Dindigul District on the basis of petitioner's application, dated 20.5.2025. 2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner herein claims right over the subject property under a registered sale deed, dated 20.09.2024.The Petitioner also produced the joint patta for the subject property in Patta No.107. A perusal of the same would suggest that the Petitioner is a joint patta holder along with one Vijaya and Ramesh. The Petitioner 2/5
submitted an online application seeking survey of the property on 20.5.2025 in application No.2025/0123/13/012361, The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.
4.Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents 1 to 3 would submit that there is objection from one Raghuraman and hence, after conducting enquiry, the request of the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the the merits of the matter, the second respondent is directed to consider the online application of the Petitioner, dated 20.5.2025 in application No.2025/0123/13/012361 and pass final orders on its own merits after issuing notice to the Petitioner, co-pattadhars, Vijaya, Ramesh and objector Raghuraman. within a period of 12 weeks from the date of receipt of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
