PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to pass appropriate orders on the application in vide Reference No.18-1005533095 and consequently direct the 1st respondent to issue renewal passport to the petitioner within the time limit fixed by this Court.

ORDER

This Writ Petition is filed to direct the first respondent to pass appropriate orders on the application in vide Reference No.18-1005533095 and consequently to direct the first respondent to issue renewal passport to the petitioner within the time limit fixed by this Court.

2.Heard Mr.AL.Kannan, learned counsel appearing for the petitioner and Mr.V.Kathirvelu, learned Assistant Solicitor General appearing for the respondents.

3.According to the petitioner, the petitioner went to an abroad on account of his job by obtaining passport bearing No.F7006169, dated 07.03.2006. On an earlier occasion, the petitioner had obtained passport from Chennai Passport Office and thereafter, he has surrendered the said passport to the same Regional Office, Chennai. The said fact has not been mentioned in the application dated 02.06.2020, which was submitted by the petitioner for reissuance of passport. Therefore, the respondents have not considered the petitioner's application and hence, the petitioner is before this Court.

4.The learned Assistant Solicitor General appearing for the respondents would submit that the petitioner has not disclosed the aforesaid fact in the application for re-issuance of passport submitted before the first respondent and subsequently, the said file has also been closed on 29.01.2020 and thereafter, the petitioner has not approached the Passport Authority. If the petitioner has to make a fresh application for re-issuance of passport by disclosing all the details, the same will be considered.

5.The learned counsel appearing for the petitioner has also agreed to give a fresh application for re-issuance of passport, to the first respondent by furnishing all the details. 6.In view of the above, this Court directs the petitioner to give a fresh application for re-issuance of passport to the first respondent by disclosing all the details and the same shall be considered on merits and in accordance with law as well as the Rules framed thereunder.

7.With the above direction, this Writ Petition is disposed of. No costs.
