ORDER
This Writ Petition has been filed seeking a mandamus directing the second respondent to not cancel or transfer the registration certificate in vehicle number TN57BH-4711, based on petitioner's representation dated 16.08.2021.
2. The learned counsel appearing for the petitioner would submit that at the instance of the third respondent, the petitioner's vehicle bearing Registration No.TN57BH-4711 was sold to third parties. Hence, the present Writ Petition.
3. Per contra, the learned Special Government Pleader appearing for the second respondent would submit that no one has filed an application for 2/5
cancellation or for transferring of the Registration Certificate of the vehicle bearing Registration No.TN57BH-4711.
4. I have given due consideration to the submissions made on either sides.
5. It appears that the third respondent is a Finance Company, and the petitioner has availed vehicle loan from them by hypothecation of his vehicle bearing Registration No.TN57BH-4711. However, as there was nonpayment of instalments, as per the terms and conditions, the vehicle was sold to third parties. In the facts and circumstances, this Court is of the view that if there is money dispute between the parties, that has to be resolved only by way of filing a suit before the Civil Court and not by seeking a mandamus before this Court. The petitioner having agreed to the terms and conditions imposed by the third respondent Finance Company, cannot insist this Court to issue mandamus, after default. Therefore, this Writ Petition is devoid of merits.
6. At this juncture, the learned counsel appearing for the petitioner would submit that the third respondent is supposed to intimate the petitioner about the sale of his vehicle. However, the same was not done. 3/5
7. The petitioner's remedy to claim compensation or other relief, as against the violation of terms and conditions by the third respondent, lies either before the Civil Court or before the appropriate forum and not before this Court.
8. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
