PRAYER :- This Criminal Original Petition filed under Section 528 of BNSS, 2023, to pass an order of direction to direct the 2nd respondent and his police officials that not to interfere into the civil dispute, relating to the suit in O.S.No.21 of 2026 on the file of the learned District Munsif Court, Srivaikundam and not to harass the petitioners in the guise of enquiry in relating to the said shop dispute. 1/4

ORDER

The present petition has been filed seeking a direction as against the respondent police not to arrest the petitioner under the guise of enquiry.

2. As per the averments in the petition, the petitioners are the tenants in the third respondent's property and the third respondent has already filed O.S.No.21 of 2026 on the file of the learned District Munsif, Srivaikundam, seeking permanent injunction. So far no interim orders have been granted.

3. The grievance of the petitioner is that the respondent police are interfering in the landlord tenant dispute and threatening the petitioner to vacate the premises and hand over possession to the third respondent. 2/4

4. The learned Government Advocate(crl.side) appearing for the respondents 1 and 2, submits that an FIR has been registered as against the petitioners in crime No.95 of 2026 dated 02.04.2026 and the petitioners have obtained anticipatory bail.

5. Considering the above said facts, it is clear that when a civil suit is pending, the respondent police cannot interfere in the said dispute. There shall be a direction to the respondent police not to interfere in the civil dispute.

6. With the above said observations, this Criminal Original Petition stands disposed of.
