ORDER
The petitioner has filed this petition with a grievance that he is not in a position to put up a compound wall in his property, despite having two civil Court decrees in his favour.
2.The learned counsel appearing for the petitioner submits that the petitioner has obtained a decree of injunction as against the private individuals for constructing a compound wall in the suit subject property in O.S.No.186 of 2006 dated 10.01.2007. He has also obtained another decree of injunction as against the Panchayat and TNEB restraining them from laying road and electricity pole in O.S.No.98 of 2008 dated 01.12.2016. Despite the same, when the petitioner attempted to construct a compound wall in his property, the private individuals, who lost in the suit, are raising objections. Therefore, he has made a request for Police protection for construction of compound wall based on the decree, which he has already obtained in O.S.No.186 of 2006. However, was also not considered. Therefore, the petitioner is before this Court. 2/5
3.The learned Government Advocate(Crl.side) appearing for the respondents submits that they are ready to give Police protection, however, protection can be provided only after measuring the land. 4.Admittedly, the petitioner was obtained a decree of injunction as against the private individuals in O.S.No.186 of 2006 dated 10.01.2007 for constructing a compound wall in the suit subject property. The survey number, extent, boundaries are mentioned in the subject property itself. In the event, if there is no appeal if the decree got confirmed, it attained finality.
5.Therefore, this criminal original petition is disposed of with a direction to the respondent Police to provide Police protection, based on the decree in O.S.No.186 of 2006 dated 10.01.2007, which was already granted by the competent civil Court. Accordingly, this criminal original petition is disposed of.
