ORDER

Heard both sides.

2.The petitioner seeks patta in respect of the land to be carved out for the petition mentioned survey number. Survey No.738/B of Melakulathoorpatti has been classified as "Manthaiveli Poramboke". Such lands are communal lands. They cannot be transferred or converted to private use. The Government had already issued G.O(Ms)No.75 dated 25.08.2007 bringing them under prohibitory index. Therefore, the petitioner's request cannot be complied with. 3.I declined to grant the relief sought for. The petitioner is permitted to submit a fresh representation before the first respondent seeking issuance of free house site patta. The first respondent is directed to consider the same and pass an appropriate order on merits and in accordance with law by taking into account the eligibility of the writ petitioner.

4.With the aforesaid direction, this writ petition is disposed of. There shall be no order as to costs.
