Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the first and second respondents to take legal action against the third respondent for the illegal encroachment of the poromboke land in S.F.No.541/2, 534/2, 535/1, 538/1, 539/1, 572/3, 542/2A and pathway going to the Kaliyaperumal Kovil in T.Muruganpatti village.

O R D E R

(Order of the Court was made by K.K.SASIDHARAN, J.) The petitioner filed this writ petition to direct the respondents 1 and 2 to take appropriate action against the third respondent for removal of encroachment.

2.The learned Additional Government Pleader submitted that the second respondent has already initiated action for removal of encroachment. According to the learned Additional Government Pleader, since the third respondent stored explosive substance, further proceedings could not be taken.

3.We direct the second respondent to continue the process of eviction till its logical end, after issuing notice to all the encroachers including the third respondent. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

4.The writ petition is disposed with the above direction. No costs.
