PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticpatory Bail in Crime No.43 of 2024 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 174(3) Cr.P.C. altered into Sections 147, 148, 302 and 341 IPC in Crime No.43 of 2024 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that when the defacto complainant's husband was returning home from the work place, in a two wheeler, some unknown persons assaulted him with iron rod and caused grievous injuries and due to the same he died.

3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor for the respondent opposes to grant anticipatory bail to the petitioner on the ground that one Syed Mohammed, who is the Jamath President, has arranged henchmen from Dindigul for doing away with the defacto complainant's husband and the petitioner herein is one of the henchmen from Dindigul.

5.Considering the seriousness of the offence and the objection raised by the learned Additional Public Prosecutor, this Court is not inclined to grant bail to the petitioner.
