PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the respondents 1 and 2 to consider the petitioner's representation dated 31.05.2023 and to direct the third respondent to return the mobile phone of petitioner's deceased son obtained for enquiry in Crime No.69 of 2023 on the file of the third respondent Police. When the matter was taken up for hearing, learned Government Advocate (Criminal Side) submitted that the mobile phone belonging to the defacto complainant was mixed up with the case records and was available with CD file in a shield cover and reported further that, they are ready to hand over the mobile phone to the defacto complainant.

2. Learned counsel for the petitioner would submit that the defacto complainant is present before this Court and now, he is prepared to take the mobile phone.

3. In view of the above, since the mobile phone is handed over to the defacto complainant, no further directions are required to be passed in this case.
