ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2), 296(b) and 351(2) of BNS, 2023 r/w. Section 4 of TNPHW Act in Crime No.Not Known of 2025, seeks anticipatory bail.

2. Today, when the matter is taken up for hearing, the learned Government Advocate (Criminal Side), on instructions from the respondent Police, submitted that the petition enquiry is pending, in C.S.R.No.205 of 2025, against the petitioner.

3. The learned Counsel for the petitioner submitted that the respondent police is harassing the petitioner under the guise of enquiry.

Considering the facts and circumstances of the case, the respondent police is directed to follow the procedure under Section 35 of BNSS, and to conduct the enquiry and if any prima facie case is made out against the petitioner, register the F.I.R. or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order.

5. Till such time, the petitioner shall not be arrested by the respondent police.
