PRAYER: Criminal Revision Case filed under Section 397(1) read with 401 of Cr.P.C., to call for records in Cr.M.P.No.1358 of 2018 on the file of learned Judicial Magistrate No.I, Virudhunagar, Virudhunagar District and set aside the order, dated 29.05.2018 and direct the respondent herein to grant the interim custody of the Honda Dream Yuga bearing registration No.TN-84-C-9380, which has been seized by the respondent herein in Crime No.142 of 2017. This Criminal Revision Case has been filed against the order of the learned Judicial Magistrate No.I, Virudhunagar, dismissing the application filed by the petitioner, to return back the two wheeler belonging to the petitioner.

2.The learned Government Advocate would submit that confiscation proceedings are pending before the District Revenue Officer, Virudhunagar and therefore, pending the proceedings, the vehicle belonging to the petitioner cannot be returned back. 3.In the facts and circumstances of the case, the petitioner is directed to participate in the confiscation proceedings and seek for his remedy, subject to the result of the confiscation proceedings, which is now pending before the District Revenue Officer, https://hcservices.ecourts.gov.in/hcservices/ Virudhunagar.

4.With the above direction, this Criminal Revision Case is disposed of.
