ORDER
This writ petition has been filed for a direction to the respondent police to provide police protection to the petitioner to carry out the renovation work at Srikaliamman temple at Naalukottai village, Sivagangai District.
2.The case of the petitioner is that he is the hereditary trustee of Sri Athikunda Varada Ayyanar Temple, appointed by the HR & CE Department. The HR & CE department, by its proceedings, dated 30.07.2018, has granted an Administrative Approval and also a technical sanction for the renovation of the Sri Kaliamman Temple Vimanam situated within the Sri Athikunda Varada Ayyanar Temple. For the purpose of doing the renovation work, donations have also been received and the same has also been specified in the Administrative Approval granted by the HR & CE department.
3.The petitioner made a representation to the respondent police seeking for police protection on the grounds that certain persons are trying to interfere with the renovation work. 4.In the facts and circumstances of the case, since HR&CE department has already granted sanction for carrying out the renovation work at Sri Kaliamman Temple and donation has also been received for this purpose, no useful purpose will be served by keeping the work pending. If there is any inter-se dispute between the parties, that has been worked separately in the manner known to law. That must not come in the way of carrying out the renovation work in the temple. It is also clear that just because the petitioner has been permitted to carry out the renovation work that will not give him any special status or right. 5.
The second respondent is directed to give necessary police protection to the petitioner to carry out the renovation work at Sri Kaliamman Temple Vimanam. The petitioner shall make a representation to the second respondent specifying the total number of days, for which the protection is required in order to carry out the renovation work. The second respondent shall consider the same and grant sufficient protection during the days when the renovation work is carried out.
6.With the above direction, this Writ petition is disposed of. No costs.
