ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 14.04.2026 for the offences punishable under Sections 11(4) r/w 12 of POCSO Act, 2012, in Crime No.37 of 2026, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 13.04.2026, the petitioner had sexually harassed the victim girl and when the same was came to the knowledge of her family, the petitioner scolded her with filthy language and threatened her father with dire consequences. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and not committed any offence as alleged by the prosecution. The petitioner is in judicial custody from 14.04.2026. He is ready to abide any conditions imposed by this Court. Hence, prays to release him on bail.

4.The learned Counsel for State of TN (Crl.Side) appearing for the respondent police would submit that the petitioner has sexually harassed the victim girl. In this case though charge sheet has already been filed before the concerned Court, considering the nature of grave offence, he strongly oppose to grant bail to the petitioner. 5.Considering the above facts and circumstances and also the facts that the petitioner is in judicial custody from 14.04.2026, that the investigation has been completed and charge sheet also filed before the concerned Court and that the petitioner is not having any bad antecedents, this Court is inclined to grant bail to the petitioner subject to the following conditions:
6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Thoothukudi.

(i)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (ii)the petitioner shall report before the Special Court for Exclusive Trial of Cases under POCSO Act, Thoothukudi daily at 10.30 a.m., until further orders; (iii)the petitioner shall not tamper with evidence or witness;
(iv)the petitioner shall not abscond during trial; (v)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
(vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023. (K M S J) 27.05.2026 PNM 4/6
