ORDER

The petitioner/1st accused, who was arrested and remanded to judicial custody on 04.05.2026 for the offences punishable under Sections 296(b), 105 of BNS @ 105 of BNS, in Crime No.102 of 2026, on the file of the respondent Police, seeks bail.

2. The prosecution case is that due to a prior property dispute between the defacto complainant's husband and his brother, there was previous enmity between them. On 03.04.2026, a wordy quarrel arose, during which the accused persons allegedly attacked the defacto complainant's husband and abused him in filthy language. On coming to know of the incident, the defacto complainant rushed to the place of occurrence and found her husband injured. He was taken to the hospital in a 108 Ambulance, where she was later informed that he had succumbed to the injuries. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he did not commit any such offences. Further, the second accused was released on bail vide order of this Court in Crl.O.P(MD) No.9095 of 2026, dated 06.05.2026. Hence, he prays to grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent Police would submit that investigation is still pending and only due to the act of the petitioner and another, the defacto complainant's 2/4

husband died. Hence, he strongly opposed the grant of bail to the petitioner.

5. Considering the above facts and circumstances and also the fact that investigation is pending and the petitioner is in judicial custody only from 04.05.2026, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
