Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the second respondent herein to grant petitioner the building plan approval to construct the proposed building for running hollow bricks manufacturing business in Re-Survey No.101/2E of Attoor Village, Kanyakumari District consisting of 50 cents on the basis of his application and other relevant documents submitted before him dated 22.03.2019.

ORDER

The limited prayer in this Writ Petition is for a Mandamus to direct the second respondent / the Executive Officer, Attoor Town Panchayat, Kanyakumari District, to grant approval for building plan for construction of a building for a hollow bricks manufacturing business in Re-Survey No.101/2E, Attoor Village. 2.Evidently, no positive direction can be issued to the second respondent for grant of building plan approval. However, learned Government Advocate confirms that the request of the petitioner in this regard is admittedly pending before the second respondent. 3.In the light of the aforesaid and in the interests of justice, it would suffice that the second respondent be directed to https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.16407 of 2019 consider the representation of the petitioner dated 22.03.2019 filed along with annexures and dispose the same, after hearing the petitioner, on merits and in accordance with law within a period of four weeks from today.

4.This Writ Petition stands disposed of in the aforesaid terms. No costs.
