PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No.10 of 2026 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 16.02.2026 for the offences punishable under Sections 5(m) r/w 6(1) of POCSO Act, 2012 in Crime No.10 of 2026, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner, who is aged about 42 years, has committed sexual assault on the five year old child. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that though the period of 90 days 2/4
have expired from the date of arrest, the respondent police have not filed the charge sheet sofar. Hence, he seeks bail. 4.The learned Counsel for the State of Tamil Nadu (Crl. side) strongly opposed to grant bail on the ground that the respondent police filed the charge sheet through E-filing on 26.03.2026 and the same is yet to be taken on file.
5.Considering the merits of this case, this Court is not inclined to grant bail to the petitioner at this point of time. Hence, this petition is dismissed. The petitioner is at liberty to approach the trial Court for statutory bail if the charge sheet is not filed sofar.
