The Writ Petition has been filed for the issue of a Writ of Mandamus, directing the respondents to provide suitable employment to the petitioner on compassionate ground based on her qualification in the respondents department.
2. The case of the petitioner is that her father was working as Grade I Head Constable and he died on 02.08.2007, while he was in service. On 17.08.2007, the petitioner's mother made an application to the respondents seeking compassionate appointment. The said application is pending and the petitioner's mother name was placed under the waiting list for consideration of compassionate appointment. In the meantime, the petitioner's mother was crossed the age of 57 years and hence, she made a representation on 28.10.2020, seeking compassionate appointment to the petitioner. However, till date no order has been passed by the respondents. Hence, the petitioner has come out with the present Writ Petition.
3. Even though the petitioner has made a larger relief, in the hearing today, the learned counsel appearing for the petitioner https://hcservices.ecourts.gov.in/hcservices/ ____________
W.P.(MD) No.16529 of 2020 restricted the prayer and submitted that it would suffice, if there is a direction to the second respondent to dispose the representation of the petitioner's mother dated 28.10.2020.
4. The learned Standing Counsel for the Government appearing for the respondents would submit that the mother of the petitioner's application has been pending with the respondents and the same will be considered.
5. Considering the limited scope of prayer now sought for by the learned counsel for the petitioner, this Court, without expressing any opinion on the merits of the matter, directs the second respondent to consider the mother of the petitioner's representation dated 28.10.2020, on its own merits and in accordance with law and pass orders as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above directions, this Writ Petition is disposed of. No costs.
