PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to direct the respondent to serve summon on the accused in P.R.C.No.22 of 2016 and further direct the Judicial Magistrate, Valliyoor to conclude the committal proceedings in P.R.C.NO.22 of 2016 within a time frame fixed by this Court. O R D E R

This petition has been filed to direct the respondent to serve summon on the accused in P.R.C.No.22 of 2016 and further direct the Judicial Magistrate, Valliyoor to conclude the committal proceedings in P.R.C.NO.22 of 2016 within a time frame fixed by this Court.

2. The petitioner is the complainant in the above said criminal case, which was filed for the offence punishable under Sections 147, 148, 341, 294(b), 323, 302, 506(ii) and 120-B of IPC. Now, the grievance of the petitioner is that even though the case was filed in 2014 and still the matter is not disposed of on merits.

3.The learned Additional Public Prosecutor would submit that investigation has been completed and Final Report was filed before the Judicial Magistrate, Valliyoor and the same was taken on file in PRC No.22 of 2016.

4.Considering the oldness of the crime, there shall be a direction to the learned Judicial Magistrate, Valliyoor, to complete https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.10588 of 2019 the committal process in P.R.C.No.22 of 2016, which is pending on its file within four months from the date of receipt of a copy of this order. After disposal of the same, compliance report must be submitted to the Registry of this Court.

4.With the above direction, this Criminal Original Petition stands disposed of.
